Supreme Court allows new sub-categories: Important decision for Scheduled Castes and Tribes

Supreme Court: The Supreme Court has given an important decision related to reservation. The Constitution Bench of seven judges decided by majority that the state governments are allowed to create new sub-categories for Scheduled Castes (SC) and Scheduled Tribes (ST). This decision was headed by Chief Justice DY Chandrachud.

Big decision of Supreme Court: The Supreme Court in its recent decision has overturned the decision given by five judges in the 2004 EV Chinnaiya case.

In the earlier decision, the Supreme Court had clarified that sub-categories cannot be created in Scheduled Castes (SC) and Scheduled Tribes (ST). But now, a majority bench of six judges headed by Chief Justice DY Chandrachud has ruled that state governments can create new sub-categories within the SC and ST categories.

The decision of the Constitution Bench of the Supreme Court: The Constitution Bench of the Supreme Court comprised Chief Justice DY Chandrachud along with Justice BR Gavai, Justice Vikram Nath, Justice Bela M Trivedi, Justice Pankaj Mittal, Justice Manoj Mishra and Justice Satish Chandra Sharma. The court had reserved the decision on this matter on February 8. The hearing lasted for three days, after which the bench gave this important decision.
